5、uction Internationally, code officiais recognize the need for a modem, up-to-date property maintenance code governing the maintenance of existing buildings. The International Property Maintenance Code, in this first edition, is designed to meet this need through model code regulations that contain c

6、lear and specific property maintenance requirements with required property improvement provisions. The International Property Maintenance Code was developed by the International Code Council (ICC) through a committee made of representatives from Building Officials and Code Administrators Internation

7、al, Inc. (BOCA), the International Conference of Building Officials (ICBO) and the Southern Building Code Congress International (SBCCI). It is designed to be compatible with the BOCA National Codes published by BOCA, the Uniform Codes published by ICBO, the Standard Codes published by SBCCI, and, e

8、ventually, all the International Codes published by the International Code Council. The Internationul Property Maintenance Code provides many benefits, among which is the model code development process that offers an international forum for code officials and other interested parties to discuss perf

9、ormance and prescriptive code requirements. This forum provides an excellent arena to debate proposed revisions. This model code also encourages international consistency in the application of provisions. Development The first draft of the International Property Maintenance Code was prepared in 1996

10、 by a development committee appointed by and consisting of representatives of BOCA, ICBO and SBCCI. The intent was to draft a comprehensive set of regulations for existing buildings that was consistent with and inclusive of the scope and content of the existing model property maintenance codes. Thes

11、e codes were the current editions of the BOCA National Property Maintenance Code, Uniform Code for Abatement of Dangerous Buildings, Unvbrm Housing Code, Uniform Code for Building Conservation (Chapters 4 and 7), Standard Housing Code, Standard Unsafe Buildings Abatement Code, and the Standard Exist

12、ing Buildings Code (maintenance provisions only), including any approved amendments thereto. Public Hearing In order to gain the views of property maintenance code users, industries and all other interested parties, the final draft of the International Property Maintenance Code was developed by util

13、izing the formal ICC Code Development Process. Hearings were conducted to consider proposed changes to the First Draft in April of 1997 at a joint meeting of BOCA, ICBO and SBCCI, in conjunction with the processing of proposed changes to the International Plumbing, Private Sewage Disposal and Mechan

14、ical Codes and the Second Draft of the International Zoning Code. Final action on the proposed changes was taken at the respective Annual Business Meetings of the three organizations, in accordance with the formal ICC Code Development Procedures. Adoption The International Property Maintenance Code

15、is available for adoption and use by jurisdictions internationally. Its use within a governmental jurisdiction is intended to be accomplished through adoption by reference in accordance with proceedings establishing the jurisdictions laws. At the time of adoption, jurisdictions should insert the app

16、ropriate information in provisions requiring specific local information, such as the name of the adopting jurisdiction. These locations are shown in bracketed words in small capital letters in the code and in the sample adoption ordinance. The sample adoption ordinance on page v addresses several ke

17、y elements of a code adoption ordinance, including the information required for insertion into the code text. 18、edure of the International Property Maintenance Code assures the highest degree of care, BOCA, ICBO, SBCCI, their members and those participating in the development of this code do not accept any liability resulting from compliance or noncompliance with the provisions given herein, for any restricti

19、ons imposed on materials or processes, or for the completeness of the text. BOCA, ICBO and SBCCI do not have power or authority to police or enforce compliance with the contents of this code. 21、onal Codes are designed and promulgated to be adopted by reference by ordinance. Jurisdictions wishing to adopt the 1998 Internationul Property Maintenunce Code as an enforceable regulation governing existing structures and premises should ensure that certain factual information is included in the a

22、dopting ordinance at the time adoption is being considered by the appropriate governmental body. The following sample adoption ordinance addresses several key elements of a code adoption ordinance, including the information required for insertion into the code text. Bill Number Ordinance Number An o

23、rdinance establishing the minimum regulations governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit f

24、or occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures; known as the Property Maintenonce Code. Be it ordained by the GOVERNING BODY of the NAME OF JURISDICTION as foiows: Section 1. That a certain document, thr

25、ee (3) copies of which are on file in the office of the JURISDICTIONS KEEPER OF RECORDS of the NAME OF JURISDICTION , being marked and designated as “The International Property Maintenance Code, First Edition, 1998” as published by the Building Officials and Code Administrators International, Inc.,

26、the Intemational Conference of Building Officials, and the Southern Building Code Congress International, Inc., be and is hereby adopted as the Property Maintenance Code of the STATE NAME ; for the control of buildings and structures as herein provided; and each and all of the regulations, provision

27、s, penalties, conditions and terms of said Property Maintenance Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, if any, prescribed in Section 2 of this ordinance. These regulations shall be known as the Property Maintenance Code of NAME OF JURISDICTION, hereinafter referred to as “this code.” 101.2 Scope. The provisions of this code shall apply to

41、 all existing residential and nonresidential structures and all exist- ing premises and constitute minimum requirements and stand- ards for premises, structures, equipment, and facilities for light, ventilation, space, heating, sanitation, protection from the ele- ments, life safety, safety from fir

42、e and other hazards, and for safe and sanitary maintenance; the responsibility of owners, operators and occupants; the occupancy of existing structures and premises, and for administration, enforcement and penal- ties. 101.3 Intent. This code shall be construed to secure its ex- pressed intent, whic

43、h is to ensure public health, safety and welfare insofar as they are affected by the continued occupancy and maintenance of structures and premises. Existing structures and premises that do not comply with these provisions shall be altered or repaired to provide a minimum level of health and safety

44、as required herein. 101.4 Severability. If a section, subsection, sentence, clause or phrase of this code is, for any reason, held to be unconstitu- tional, such decision shall not affect the validity of the remain- ing portions of this code. SECTION 102 APPLICABILITY 102.1 General. The provisions o

45、f this code shall apply to all matters affecting or relating to structures and premises, as set forth in Section 101. Where, in a specific case, different sections of this code specify different requirements, the most restrictive shall govern. 102.2 Maintenance. Equipment, systems, devices and safe-

46、 guards required by this code or a previous regulation or code under which the structure or premises was constructed, altered or repaired shall be maintained in good working order. The requirements of this code are not intended to provide the basis for removal or abrogation of fire protection and sa

47、fety systems and devices in existing structures. Except as otherwise specified herein, the owner or the owners designated agent shall be responsible for the maintenance of buildings, structures and premises. 102.3 Application of other codes. Repairs, additions or altera- tions to a structure, or cha

48、nges of occupancy, shall be done in accordance with the procedures and provisions of the building, plumbing and mechanical codes and NFPA 70. Nothing in this code shall be construed to cancel, modify or set aside any provision of the zoning code. 102.4 Existing remedies. The provisions in this code

49、shall not be construed to abolish or impair existing remedies of the jurisdiction or its officers or agencies relating to the removal or demolition of any structure which is dangerous, unsafe and insanitary. 102.5 Workmanship. Repairs, maintenance work, alterations or installations which are caused directly or indirectly by the enforcement of this code shall be executed and installed in a workmanlike manner and installed in acco
