2、E EBU AND ITS MEMBERS AND THEIR USE BY THIRD PARTIES AND TELECOMMUNICATIONS ADMINISTRATIONS Recommendation proposed by the “Telephone Operation and Tariffs” Working Group T/WG 2 (Tph) Text of the Recommendation adopted by the “Telecommunications” Commission: “The European Conference of Postal and Te

3、lecommunications Administrations, considering - that the general tariff principles and the conditions for the lease of television, sound-programme and telephone - that the supplementary tariff principles are defined in CEPT Recommendation T/Tph 25 E, - that the lease of permanent networks facilitate

4、s service operations for the EBU and has advantages for the member Administrations involved as far as conditions and operating costs are concerned, - that the Administrations concerned have signed agreements with broadcasting organizations who are members of the EBU, in order to define the terms and

5、 conditions for the use of the earth segment of the EUTELSAT European Communications Satellite by these organizations, - that the EBU has leased from EUTELSAT two transponders in the EUTELSAT space segment on an exclusive and full-time basis for the transmission of broadcast signals between its memb

6、ers. The leasing conditions are the subject of specific contractual provisions established between EUTELSAT and the EBU in their agreement of 20 January 1982, circuits for private use are set out in CCITT Recommendations D.l, D.2, D.4 and D.310 R, O taking account - of the need to specify the condit

7、ions of use applicable to permanent or occasional international circuits leased by the members of EBU and third parties, recognizing that 1.1. 1.2. For several years, some broadcasting organizations as members of the EBU have leased a number of television, sound-programme and control circuits which,

8、 together, make up a network operated by the EBU. In general, Administrations cannot accept that international associations, e.g. banks or transport companies, establish international telecommunications networks to carry trafic between their members. However, as far as the EBU is concerned, it must

9、be considered that: - in some countries, certain circuits are established and owned by its members, - in other countries, its members are authorized by law to establish circuits of their own, but have chosen In the above-mentioned cases, the EBU members must therefore be considered renters and the E

10、BU the user of the leased circuits. O not to do so for practical reasons. 1. In accordance with the general principles applied by telecommunications Administrations when leasing international telecommunications circuits for private use, circuits cannot be made available to third parties. However, it

11、 must be determined whether, and to what extent, the above provision applies to the international circuits permanently leased to EBU members. 1.4. Cases can be envisaged in which Administrations are unable to undertake not to use the leased ciurcuits occasionally and exceptionally. recommends that t

LEASING When ordering leased circuits, the time that may be neces

13、sary for planning and establishing the circuits must be taken into account. The minimum period of lease and the arrangements for cancellation shall be agreed between the Administrations and the renters of the circuits. Permanently-leased television circuits are provided on a full-time basis. The Adm

14、inistration at the destination point of a link shall be responsible for coordinating the provision of a temporary television link, in consultation with the Administrations involved. In principle, orders must be received by the Administrations five working days in advance. Administrations will do the

15、ir best to provide circuits at shorter notice if the five-day period of notice cannot be observed. GENERAL PROVISIONS CONCERNING THE USE OF THE LEASED CIRCUIT NETWORK Use by the European and non-European members of EBU The rules are applicable to circuits leased by the EBU and its members. They appl

16、y to leased television, sound-programme and control circuits. In all cases, unless otherwise agreed, only the Categories of transmission for which the different categories of circuits are intended shall be allowed. EBU members that have leased parts of the networks provided on a permanent basis and

17、all other European members of the EBU are entitled to use the circuits spedified under 3.1.1. for transmissions between each other. All members within the European Broadcasting Area as it is defined in the Radio Regulations of the ITU must be considered European members of the EBU. Organizations tha

18、t are not members of the EBU are considered third parties. Leased circuit networks may not only be used for transmissions between the EBU members but also for transmissions from third parties to European members of the EBU and to non-European members of the EBU. The use of the SIS (sound-in-syncs) s

19、ystem for the transmission of sound is permitted. Use by third parties Leased circuit networks must not be used: - for transmissions between third parties, - for transmissions from members of the EBU to third parties, unless the circuits are used simultaneously by a European member of the EBU, - for

20、 transmissions recorded by a member of the EBU for the benefit of a third party. Transmissions specified under 3.2.1. should be effected on occasional circuits. If occasional circuits are not available or if a transmission continues on leased circuits immediately after a transmission that correspond

21、s with the definitions under 3.1.4, third parties shall exceptionally be permitted to use leased circuits if the EBU so requests and provided that the tariff provisions of the present Recommendation are applied. The use of the SIS (sound-in-syncs) system for the transmission of sound shall only be p

22、ermitted if it can be used over the whole length of the television circuit, from the point of origin to the point of destination of the transmission. As long as in a certain relation there are no circuits of the same category available other than those specified under 3.1.1. and on condition that th

23、e use of the circuits by the EBU and its members is not affected, the telecommunications Administrations reserve themselves the right to make the leased circuits also available to other applicants, in cooperation with the EBU. TARIFF AND ACCOUNTING PROVISIONS FOR TELEVISION TRANSMISSIONS DESTINED Gi

24、ven that the network leased by the EBU can be used by its non-European members and, in exceptional cases, also by third parties; that the charges for the terrestrial network as well as the rental for the lease of the earth segment are paid to the Administrations by the EBU members, whereas the renta

26、. The EBU shall confirm to the Administrations concerned, in the first half of the month following the transmission, any use of the leased circuits by non-European members or third parties. The addressee of the invoice and the Administration responsible for collecting the charges shall be clearly in

27、dicated. The European terminal Administration shall be responsible for collecting the charges from the non-Euro- pean members and/or third parties receiving the transmission. The EBU shall notify on a quarterly basis its members and the Administrations of the amounts payable by the Administrations t

28、o EBU members for the use of permanently leased circuits. This information shall be given within three months following the quarter concerned. When the transmission is carried over the terrestrial network : a) charges are calculated on the basis of the tariff applicable for occasional transmission;

29、b) Administrations shall grant automatically, on the basis of the quarterly lists (see items 4.1. and 4.3.), to the European members of the countries concerned an allowance pro rata of the leased circuit charge for the section actually used. If the transmission is carried over the satellite network:

30、 a) the Administrations shall bill third parties on the basis of the rate for occasional use (earth + space segment). In the case of overruns, a higher initial charge shall not be payable for the first minutes. The EBU members are granted an allowance of SDR 14.7 per minute for the entire space segm

31、ent. This allowance shall be divided between the owners of the earth stations on the basis of the quarterly lists (see items 4.1. and 4.3.); for non-European members, the rate for the earth segment in each country has been fixed at SDR 11.5/minute*. In the case of overruns, a higher initial charge s

32、hall not be payable for the first minutes; b) Administrations shall automatically give an allowance of SDR l/minute to the European members of the countries concerned for the earth segment, on the basis of the quarterly lists (see items 4.1. and 4.3.). This amount corresponds to the mean value of th

33、e rentals for the earth segments, assuming a daily period of use of i4 hours. When the transmission is carried over both terrestrial and satellite netwoks, the provisions of items 4.4. and 4.5. shall apply. For transmissions in which European and non-European members of the EBU and/or third parties

34、participate, no allowance shall be given and no charge be raised for an overrun of 15 minutes or less requested by a non-European EBU member and/or third parties. In the case of overruns on occasional circuits, the appropriate charges shall be applied. If the overrun exceeds 15 minutes, the charge payable shall be calculated on the basis of the total duration of transmission.” * Lower charges may be applied in certain circumstances, for instance if the national broadcasting organization provides the access circuits to the earth station.
