This part prescribes requirements for obtaining a license to reenter a reentry vehicle other than a reusable launch vehicle (RLV), and post-licensing re-quirements with which a licensee must comply to remain licens
7、ed. Require-ments for preparing a license applica-tion are contained in part 413 of this subchapter. 435.3 Types of reentry licenses. (a) Reentry-specific license. A reentry- specific license authorizes a licensee to reenter one model or type of reentry vehicle, other than an RLV, to a re-entry site
8、 or other location approved for the reentry. A reentry-specific li-cense may authorize more than one re-entry and identifies each reentry au-thorized under the license. A licensees authorization to reenter terminates upon completion of all activities au-thorized by the license or the expira-tion dat
9、e stated in the reentry license, whichever occurs first. (b) Reentry-operator license. A reentry operator license authorizes a licensee to reenter any of a designated family of reentry vehicles, other than an RLV, within authorized parameters, includ-ing trajectories, transporting specified classes
10、of payloads to any reentry site designated in the license. A reentry op-erator license is valid for a 2-year re-newable term. 435.5 Policy and safety approvals. To obtain a reentry license, an appli-cant must obtain policy and safety ap-provals from the FAA. Requirements for obtaining these approval
11、s are con-tained in subparts B and C of this part. Only a reentry license applicant may apply for the approvals, and may apply for either approval separately and in advance of submitting a complete li-cense application, using the applica-tion procedures contained in part 413 of this subchapter. 13、ry determination. (a) A payload reentry determination is required to transport a payload to Earth on a reentry vehicle unless the proposed payload is exempt from pay-load review. (b) A payload reentry determination made under a previous license applica-tion under this subchapter may satisfy the requ
14、irements of paragraph (a) of this section. (c) The FAA conducts a review, as de-scribed in subpart D of this part, to make a payload reentry determination. Either a reentry license applicant or a payload owner or operator may request a review of the proposed payload using the application procedures
15、contained in part 413 of this subchapter. Upon re-ceipt of an application, the FAA may conduct a payload reentry review inde-pendently of a reentry license applica-tion. 435.8 Human space flight. An applicant for a license to conduct a reentry with flight crew or a space flight participant on board
16、the vehicle must demonstrate compliance with 460.5, 460.7, 460.11, 460.13, 460.15, 460.17, 460.51 and 460.53 of this subchapter. Doc. 17、and determinations required under this chapter for a reentry li-cense. (b) A reentry license authorizes a li-censee to reenter a reentry vehicle and payload, if any, in accordance with the representations contained in the re-entry licensees application, subject to the licensees compliance with terms
18、 and conditions contained in license or-ders accompanying the reentry license, including financial responsibility re-quirements. 435.11 Additional license terms and conditions. The FAA may amend a reentry li-cense at any time by modifying or add-ing license terms and conditions to en-sure compliance
19、 with 49 U.S.C. Subtitle IX, chapter 701, and applicable regula-tions. 435.13 Transfer of a reentry license. (a) Only the FAA may transfer a re-entry license. (b) An applicant for transfer of a re-entry license shall submit a reentry li-cense application in accordance with part 413 of this subchapte
20、r and satisfy the applicable requirements of this part. The FAA will transfer a reentry license to an applicant who has ob-tained all of the approvals and deter-minations required under this chapter for a reentry license. In conducting its reviews and issuing approvals and de-terminations, the FAA m
21、ay incor-porate any findings made part of the record to support the initial licensing determination. The FAA may modify a reentry license to reflect any changes necessary as a result of a reentry li-cense transfer. 435.15 Rights not conferred by re-entry license. Issuance of a reentry license does n
22、ot relieve a licensee of its obligation to comply with requirements of law that may apply to its activities. 435.16431.20 Reserved Subpart BPolicy Review and Ap-proval for Reentry of a Re-entry Vehicle 435.21 General. The FAA issues a policy approval to a reentry license applicant upon com-pletion o
23、f a favorable policy review. A policy approval is part of the licensing record on which the licensing deter-mination is based. 435.23 Policy review requirements and procedures. Unless otherwise indicated in this subpart, regulations applicable to pol-icy review and approval of the reentry of an RLV
24、contained in part 431, sub-part B of this subchapter shall apply to the policy review conducted for a li-cense to reenter a reentry vehicle under this part. Unless otherwise stated in this sub-part, regulations applicable to safety review and approval of the reentry of an RLV contained in part 431, subpart C of this subchapter shall apply to the safety review conducted for a license to reenter a reentry ve
28、hicle under this part. 435.35 Acceptable reentry risk for re-entry of a reentry vehicle. To obtain safety approval for re-entry, an applicant must demonstrate that risk for the proposed reentry, when assessed in combination with launch of the reentry vehicle, does not exceed acceptable risk for the
29、conduct of an RLV mission as defined in para-graphs (a) and (b) of 431.35 of this sub-chapter. 435.36435.40 Reserved Subpart DPayload Reentry Review and Determination 435.41 General. The FAA conducts a payload reentry review to examine the policy and safe-ty issues related to the proposed re-entry o
