The basic appeal of the Commentary is this: it provides in a small package and at reasonablecost

6、 thorough coverage of many issues likely to be dealt with when using the International Swimming Pool and Spa Codeandthen supplements that coverage with historical and technical background. Reference lists, information sources and bibliogra-phies are also included.Throughout all of this, strenuous ef

7、fort has been made to keep the vast quantity of material accessible and its method of pre-sentation useful. With a comprehensive yet concise summary of each section, the Commentary provides a convenient referencefor swimming pool and spa regulations. In the chapters that follow, discussions focus on

8、 the full meaning and implications of thecode text. Guidelines suggest the most effective method of application and the consequences of not adhering to the code text.Illustrations are provided to aid understanding; they do not necessarily illustrate the only methods of achieving code compliance.The

These regulations shall be known as theSwimming Pool and Spa Code of NAME OF JURISDICTION,hereinafter referred to as “this code.”This section sets forth the scope and

21、 intent of thecode as it applies to new and existing swimmingpools and spas. The adopted regulations are identi-fied by inserting the name of the adopting jurisdictioninto the code.A 101.2 Scope. The provisions of this code shall apply tothe construction, alteration, movement, renovation, replace-me

22、nt, repair and maintenance of aquatic recreation facilities,pools and spas. The pools and spas covered by this code areeither permanent or temporary, and shall be only those thatare designed and manufactured to be connected to a circula-tion system and that are intended for swimming, bathing orwadin

23、g.This section describes the types of swimming pool orspa construction-related activities to which the codeis intended to apply. The applicability of the codeencompasses the initial design of swimming poolsand spas, the installation and construction phasesand the maintenance of operating systems. Th

24、e codeintends to regulate any and all swimming pool- andspa-related appliances, systems and associatedequipment that can affect the health, safety and wel-Chapter 1:Scope and AdministrationGeneral CommentsThe law of building regulation is grounded on the policepower of the state. In terms of how it

25、is used, this is thepower of the state to legislate for the general welfare ofits citizens. This power enables passage of such lawsas a swimming pool and spa code. It is from the policepower delegated by the state legislature that local gov-ernments are able to enact building regulations. If thestat

26、e legislature has limited this power in any way, themunicipality may not exceed these limitations. Althoughthe municipality may not further delegate its policepower (e.g., by delegating the burden of determiningcode compliance to the building owner, contractor orarchitect), it may turn over the admi

27、nistration of buildingregulations to a municipal official, such as a code offi-cial, provided that he or she is given sufficient criteria toclearly establish the basis for decisions as to whether ornot a proposed swimming pool or spa conforms to thecode.Chapter 1 is largely concerned with maintainin

28、g “dueprocess of law” in enforcing the performance criteriacontained in the code. Only through careful observationof the administrative provisions can the code official rea-sonably hope to demonstrate that “equal protectionunder the law” has been provided. Although it is gener-ally assumed that the

29、administrative and enforcementsections of a code are geared toward the code official,this is not entirely true. The provisions also establish therights and privileges of the design professional, contrac-tor and swimming pool or spa owner. The position of thecode official is merely to review the prop

30、osed and com-pleted work and determine whether a swimming pool orspa installation conforms to the code requirements. Thedesign professional is responsible for the design of asafe swimming pool or spa.The contractor is responsible for installing the swim-ming pool or spa in strict accordance with the

31、 plans.During the course of the construction of a swimmingpool or spa, the code official reviews the activity to makesure that the spirit and intent of the law are being metand that the swimming pool or spa provides adequateprotection of public health. As a public servant, the codeofficial enforces

32、the code in an unbiased, proper man-ner. Every individual is guaranteed equal enforcementof the code. Furthermore, design professionals, contrac-tors and building owners have the right of due processfor any requirement in the code.PurposeA swimming pool and spa code, as with any other code,is intend

33、ed for adoption as a legally enforceable docu-ment to safeguard health, safety, property and publicwelfare. A swimming pool and spa code cannot beeffective without adequate provisions for its administra-tion and enforcement. The official charged with theadministration and enforcement of pool and spa

34、 regula-tions has a great responsibility, and with this responsi-bility goes authority. No matter how detailed theswimming pool and spa code may be, the code officialmust, to some extent, exercise judgment in determiningcompliance. The code official has the responsibility forestablishing that pools

35、and spas are designed and con-structed to be reasonably free from hazards associatedwith the presence and use of the pools and spas. 36、as they are affected by the instal-lation, operation and maintenance of such appliancesand systems.The key factors as to whether this code applies to aswimming pool or spa is the intended use of the poolor spa for swimming, bathing or wading and whetherthe pool or spa is designed and manufactured to

37、 beconnected to a circulation system. The pools or spascan be of permanent construction or of portable con-struction.For example, although a permanent decorativefountain not associated with a pool has a circulationsystem, the fountain is not intended for swimming,bathing or wading. Thus, the fountai

38、n is not coveredby the code. Similarly, consider a portable plasticwading pool intended for wading, but not designed tobe connected to a circulation system. Therefore, thewading pool is also not covered by the code. SeeCommentary Figures 101.2(1) through 101.2(4).A 101.3 Intent. The purpose of this

39、code is to establishminimum standards to provide a reasonable level of safetyand protection of health, property and public welfare by regu-lating and controlling the design, construction, installation,quality of materials, location and maintenance or use of poolsand spas.The intent of the code is to

40、 set forth requirements thatestablish the minimum acceptable level to safeguardlife or limb, health, property and public welfare. Intentbecomes important in the application of sections,such as Sections 102, 104.2, 105.2 and 108, as wellas any enforcement-oriented interpretive action orjudgment. As w

41、ith any code, the written text is subjectto interpretation. Interpretations should not beaffected by economics or the potential impact on anyparty. 42、not hazardous; do not cause the swim-ming pool, spa or equipment to be any less in compli-ance with the code than before; and are, to the extentpracticable, in compliance with the provisions of thecode applicable to new work.A 102.5 Historic buildings. The provisions of this coderelating to the cons

43、truction, alteration, repair, enlargement,restoration, relocation or moving of pools, spas or systemsshall not be mandatory for existing pools, spas or systemsidentified and classified by the state or local jurisdiction aspart of a historic structure when such pools, spas or systemsare judged by the

44、 code official to be safe and in the publicinterest of health, safety and welfare regarding any proposedconstruction, alteration, repair, enlargement, restoration, relo-cation or moving of such pool or spa.This section gives the code official the widest possi-ble flexibility in enforcing the code wh

45、ere the swim-ming pool or spa in question has historic value. Thisflexibility does not come without conditions. The mostimportant criterion for application of this section isthat the swimming pool or spa must be specificallyclassified as being of historic significance by a quali-fied party or agency

46、. Usually this is done by a state orlocal authority after considerable scrutiny. Most, if notall, states have such authorities, as do many localjurisdictions. Agencies with such authority typicallyexist at the state or local government level.A 102.6 Moved pools and spas. Except as determined bySecti

47、on 102.2, systems that are a part of a pool, spa or systemmoved into or within the jurisdiction shall comply with theprovisions of this code for new installations.Swimming pools and spas that have been relocatedare subject to the requirements of the code as if theywere new construction. Placing a po

48、ol or spa whereone did not previously exist is analogous to construct-ing a new swimming pool or spa. It is the intent of thissection to require alteration of the existing pool or spato the extent necessary to bring it into compliancewith the provisions of the code applicable to new con-struction or

49、 make the existing swimming pool or spacomply with Section 102.2.Some onground storable pools are intended to bedisassembled and stored during winter and need notbe treated as a new pool when reassembled orplaced back in use.A 102.7 Referenced codes and standards. The codes andstandards referenced in this code shall be those that are listedin Chapter 11 and such codes and sta
