24、 out infull along with the Approved Code of Practice and guidance material.The Provision and Use of Work Equipment Regulations 19981 The Provision and Use of Work Equipment Regulations 1998 (PUWER 98) aremade under the Health and Safety at Work etc Act 1974 (HSW Act) and came intoforce on 5 December
25、 1998. PUWER 98 brings into effect the non-lifting aspects ofthe Amending Directive to the Use of Work Equipment Directive (AUWED). Theprimary objective of PUWER 98 is to ensure that work equipment should not resultin health and safety risks, regardless of its age, condition or origin.What does PUWE
26、R 98 apply to?2 PUWER 98 applies to the provision and use of all work equipment, includingmobile and lifting equipment.Where does PUWER 98 apply?3 It applies to all workplaces and work situations where the HSW Act appliesand extends outside Great Britain to certain offshore activities in British ter

35、GuidanceThe Use of Work Equipment Directive and PUWER 929 PUWER 98 replaces PUWER 92 which implemented the first EuropeanCommunity (EC) Directive about work equipment, the Use of Work EquipmentDirective (UWED). This required all Member States of the EC to have the sameminimum requirements for the se
36、lection and use of work equipment.The Amending Directive to the Use of Work Equipment Directiveand PUWER 9810 The European Council of Ministers agreed a further Directive about workequipment in 1995. This was the Amending Directive to the Use of WorkEquipment Directive (AUWED). AUWED extended the re
37、quirements of UWED.PUWER 98 brought the requirements of AUWED into British law.11 PUWER 98, while replacing PUWER 92, continues its requirements inaddition to introducing the new measures required by AUWED. This was done toensure that the law relating to work equipment was consolidated into one set
38、oflegislation.AUWEDs new requirements12 AUWEDs main new requirements concern mobile work equipment, liftingequipment and the inspection of work equipment. The hardware requirements ofAUWED outline physical features that relate to the equipment itself and thesoftware requirements consist of the manag
39、ement provisions. The specificrequirements for mobile work equipment have been implemented through PUWER98. The lifting requirements have been implemented through the LiftingOperations and Lifting Equipment Regulations 1998 (LOLER). The inspectionrequirements are incorporated in both PUWER 98 and LO
40、LER.Other changes - PUWER 92 to PUWER 9813 PUWER 98 differs from PUWER 92 in a number of other ways. They are:(a) an extension of the definition of work equipment to include installations;(b) an extension of the dutyholder application to include a duty on people whohave control of work equipment suc
41、h as plant hire;2 Safe use of work equipmentBackgroundGuidance(c) guidance and ACOP material about regulation 7 (specific risks);(d) changes to regulation 10 (conformity with Community requirements);(e) minor changes to regulation 18 (control systems) as a result of a changerequired by AUWED;(f) new
42、 regulations to replace the previous regulations dealing with powerpresses.Lifting operations and lifting equipment14 The lifting requirements of AUWED are brought into effect through a set ofregulations called LOLER. LOLER replaces most of the existing legislation onlifting, for example lifting law
43、 that applies to factories, offices, shops, railwaypremises and construction sites. In doing so, it creates a single set of regulationsthat apply to all sectors.15 Though PUWER 98 applies to all lifting equipment, LOLER applies over andabove the general requirements of PUWER 98, in dealing with spec
44、ifichazards/risks associated with lifting equipment and lifting operations.16 LOLER, its supporting ACOP and guidance material are not included in thisdocument. They are found in document L113.1Power presses17 PUWER 98 revokes the Power Presses Regulations 1965 and the PowerPresses (Amendment) Regul
45、ations 1972 (the Power Presses Regulations). To ensurethat safety levels for power presses are maintained, Part IV of PUWER 98 containsspecific regulations applying to power presses. This part of PUWER 98 and itssupporting ACOP and guidance material is available separately in L112.2Woodworking18 PUW
46、ER 98 revokes the remaining requirements of the WoodworkingMachines Regulations 1974 which concern the training of operators, removal ofmaterial cut by circular sawing machines and requirements for machines with two-speed motors. The other requirements of the Woodworking Machines Regulations1974 wer
47、e revoked by PUWER 92. Because of the high accident rate and inherentrisks associated with woodworking machines, a separate ACOP with supportingguidance material has been produced concerning the safeguarding ofwoodworking machines and the training of people who use them. The ACOP andguidance materia
