They are in conformity with the delegation of authority given to the Committee by the Council in regard to panels. The d
3、ocument is primarily directed to panel members. As experience has shown that panels should carry out their work as informally as practicable, only broad directives and guidance were established for the conduct of panel business. The document also includes information that will assist States in under
4、standing the operations of panels, in determining their ability to nominate a panel member, and in choosing a member and instructing him in his duties. Purpoee and Determination of Need 1.1 Panels of the Air Transport Committee are technical groups of qualified experts formed by the Air Transport Commi
8、ttee to advance, within specified time frames or on a standing basis, the solution of specialized problems which cannot be solved adequately or expeditiously by the established facilities of the Air Transport Committee and the Secretariat. The use of panels has evolved from the need to bring togethe
9、r the best available experts to examine specialized problems and to find technically feasible solutions which would be acceptable to Contracting States as a whole. 1.2 The determination of the need for a panel is normally made by the Air Transport Committee. 2. Methods of Operation 2.1 Panels work u
10、nder the direct control of the Air Transport Committee. They conduct their business by correspondence and meetings. Usually, their work commences by correspondence and a meeting is held when the results achieved by correspondence have to be finalized or no further progress can be made through corres
11、pondence. 2.2 Panels may conduct their business between meetings by means of working groups, if necessary. If so, this shall be done with full consideration for the efforts and costs involved. To ensure effective and economic use of resources available for the work of panels, careful consideration s
12、hould be given by panels to the determination of the least number of working groups required to advance the work. 2.3 Panels are encouraged to work as informally as possible because this allows full freedom of expression. Also, experience has shown that tasks are completed more expeditiously when bu
13、siness is done on that basis. Terme of Reference a
14、nd Work Programme 3.1 When a panel is established, the Air Transport Committee establishes its terms of reference and work programme. 3.2 The terms of reference define clearly and concisely the nature and scope of the work assigned to the panel and specify the objectives sought by the Air Transport
15、Committee. The terms of reference are revised by the Air Transport Committee vhen this becomes necessary. 3.3 The work programme comprises a list of detailed items within the assigned terms of reference. The Air Transport Committee may, when appropriate, set time limits for completion of the work pr
16、ogramme or of individual items of the work programme, or give other directions as necessary. The work programme is revised by the Air Transport Committee as necessary, normally after each substantive phase of the panels work, such as following a meeting. 3.4 Each panel shall adhere to its prescribed
17、 terms of reference and work programme. However, a panel may suggest to the Air Transport Committee, normally in a panel meeting report, modifications or additions to its tem of refer- ence or work programme. These shall be supported by adequate explanations. 4. Membership 4.1 experts to serve on pa
18、nels in the Air Transport field: The following guidelines apply to the selection of a) membership on a panel should normally be from 12 to 15; b) all States should be invited to nominate members ; c) any nomination of a member must be supported by an indication of the nominees qualifications; d) mem

20、O047633 466 e) the Air Transport Committee should review and revise the membership at any time such action is considered desirable in the interests of the panels work. 4.2 When the nominations are received, the Air Trans- port Committee decides on the actual membership. If the number of nominations
21、received is not sufficient or if the balance of expertise or area representation is unduly disturbed, the Air Transport Committee may consider whether it is necessary to address States again. 4.3 When a panel has been established, all Contracting States will be informed of its membership. Any nomina
22、tions for additional members will be considered by the Air Trans- port Committee in accordance with paragraph 4.1. 4.4 A State may wish to replace its nominated member by another person. In such a case, the new nomination will be referred to the President of the Council for decision and subsequent i
23、nformation to the Air Transport Committee. 4.5 If a panel member ceases to be available to serve on the panel, fails to attend two successive panel meetings or is otherwise known to have become inactive in the work of the panel, the Secretary General will approach the State concerned to ascertain wh
24、ether a replacement will be nominated. In the event that no replacement is nominated by the State concerned within a reasonable period, the President of the Council will decide as to which other State(s) should be invited to nominate a member, nomina- tions being referred to the Air Transport Commit
25、tee for approval. 5. Participante other than Members 5.1 At meetings a member may be accompanied by advisers, but their number shall be kept to a minimum. 5.2 Also, when necessary, the Air Transport Committee may arrange for participation by individuals other than members and advisers. Such individu
26、als do not have the status of a member but act in an advisory capacity. Similarly, the panel itself may seek the advice of outside experts, on its own authority, provided that this involves no unauthorized cost to the Organization. Additionally, if a Stete or international organization informs the S

28、racting State may send observers to panel meetings . 5.4 The Air Transport Committee selects the inter- national organizations to be invited to nominate observers on the basis that their participation can be expected to make valuable or needed contributions to the panels work. The requests from othe
29、r international organizations shall be submitted to the Air Transport Committee for consideration. 5.5 “Observer”: is a person designated by a State or an internationai organization to participate in a personal expert capacity in an Air Transport Conmiittee panel meet- ing. The observer has the righ
30、t to take part in discuss- ions of the panel meeting but without the right to vote, move or second motions or amendments. He has the right to submit discussion papers for panel consideration. He will use the languages of the panel and will be provided with the documentation for the meeting. 5.6 Comm
31、ittee for alternates to members. If it is necessary to replace a member temporarily, the Air Transport Committee will authorize such a temporary replacement, at the request of the respective member or the nominator. Nominations may be accepted by the Air Transport 6. Function of Member8 6.1 The duty
32、 of members is to contribute substantially to the panels work. 6.2 Members are participating in their personal, expert capacity and not acting as representatives of their nomi- nators. Members should therefore express their professional opinions and not established policies or points of view of a St
33、ate or an international organization. 6.3 Members also serve as a roster of experts whom the Secretariat may consult on specific matters on an ad hoc basis. 7. Obligations of Nominating States and International Organizations 7.1 It is important that nominating States and inter- national organization

35、nsure that their nominees have the resources and capacity required for work by the panel and its working groups. Expenses incurred by members and their advisers, and observers, in the activities of the panel and its working groups are borne by their nominators. 1.2 As members, advisers, and observer
36、s are partici- pating in panel work in their personal, expert capacity, States and international organizations are not committed to the views expressed by their nominees. 8. Officers 8.1 Chairman of meeting. A panel elects, from among its members, a Chairman and a Vice-chairman. A panel may elect 1
37、a different Chairman at the beginning of each meeting. 8.2 Panel Secretary. Each panel is assisted by a Secretary who is designated by the Director of the Air Transport Bureau. 8.3 Rapporteur of working group. Each working group shall have a Rapporteur appointed by the panel (see paragraph 13). 9. L
38、anguages 9.1 The Air Transport Committee selects from the work- ing languages of the Organization the language or languages to be used by a panel in its correspondence and meetings. This determination is made following a consultation with the members regarding their requirements for translation and
39、interpretation services. The Air Transport Committee may subsequently modify the decision in the light of changed requirements 9.2 The meetings are members. anguage services to be provided at individual determined by the needs of attending panel 10. Lnitiation of Action 10.1 After the Air Transport

41、 484l14Lb 0047636 175 = relevant documentation available; by outlining the methods of operation agreed for the panel; and, if necessary, by making an initial survey of the problem and suggesting a suitable course of action. 11. Correspondence 11.1 Correspondence is carried out directly between the p
42、anel Secretary and members. 11.2 Contributions from members are sent to the Secretary, who reproduces and circulates them to all members. The Secretary produces documentation coneolidat- ing the contributions received and Co-ordinates panel work, as necessary. 11.3 Direct exchange of correspondence
43、between individ- ual members is useful in the development of members contri- butions and in the fostering of personal understanding amng members. However, for continuity of the work, copies of such correspondence dealing with the development of the panel task should be sent to the Secretary. 11.4 Sp
44、ecific items of a panels work programme may be assigned to individual members or groups of members for development to facilitate and expedite progress during the correspondence stage. 11.5 The Air Transport Committee determines when a co r r es pond enc e s t age s hou Id t erm ina t e. 12. Co-ordin
45、ation of Activities 12.1 The Air Transport Committee monitors the wrk of all panels, and will be kept fully informed of progress on any important. aspects or developments concerning the work of each panel. In particular, the Air Transport Committee expects to be informed when a panel is experiencing
46、 significant problems in its work. The Air Transport Committee will inform a panel of any relevant developments arising from the work of another panel or other ICAO body. 12.2 Iietween meetings of the panel, members should ensure that all other members and the panel Secretary are kept fully informed

Panel Working Group Activities 13.1 If the work of the panel is being advanced by one or more working groups and i
48、f a working group decides that a meeting of the working group should be held, advance notification of such a meeting shall also be sent to the panel Secretary by the Rapporteur. 13.2 The panel Secretary attends, when necessary and practicable, meetings of working groups. 13.3 Arrangements shall be m
49、ade by the panel Secretary with panel working group Rapporteurs for all panel members who are not members of a group to be kept informed of the working group activities and its conclusions and recommend- ations. 14. Meetings 14.1 Meetings of panels are convened by the Air Trans- port Committee. The determination of the date, duration and place of a meeting is subject to integration with the meeting programme of the Organization, in consultation with the Secretary General. 1 . 14.2 The Air Transport Committee determines the agenda of a meeting, taking into account the im
