19、ey performanceindicatorsnecessaryfortheeffectiveandefficientmanagementofcustomerscargothroughoutthe transportprocess. Itisintendedforusebytheprovidersoftheserviceandasgeneralguidancebypurchasersofsuchservices (customers)anditdefinestheprinciples,bestpracticesandobligationsoftheprovideraswellforthecl
20、ientas providingadvicewithregardtocontributionbythecustomerthatwillfacilitatethemosteffectiveoutcome. Inaddition,thisCodeofPracticestronglyrecommendsthattheserviceprovidercarryoutregularselfassessment ofperformanceagainstdefinedcriteriawiththeobjectiveofcontinuallyimprovingthequalityofservicesprovid

24、 Responsibilityandcontrol 4.1 Controloftheservice Theserviceprovidershouldhaveclearlydefinedmanagementsystemsandcontrolsinplace(seeclause5),which enabletheagreedservicetobecompleted,thedeliveryprocessmonitoredandtheservicequalitymeasured. NOTE Thecustomershouldensurethathehasfullunderstandingofthere
25、quirementslimitationsandliabilitiesoftheservice provider.Thisisparticularlyimportantwithregardtotheprovisionofinsurancecoverwhichshouldbeconsideredtobethe responsibilityofthecustomerunlessspecialarrangementshavebeenmadefortheserviceprovidertoensurethemwhilstin transit.Inthislattersituation,thecustom
26、ershouldprovidewritteninstructiontotheserviceprovider,tothiseffect. 4.2 Elementsofresponsibility 4.2.1 Contractreview Itistheresponsibilityoftheserviceprovidertoensurefullunderstandingoftherequirementsofthecustomerin ordertoplan,schedule,manageandmonitorthemovementoffreightfrominitialcollectionthrou
27、ghtodeliveryto theconsigneeorenduser. NOTE1 Thecustomershouldensurethatinformation,sufficienttoenabletheserviceprovidertofulfilhisobligations,astot he natureofandspecialrequirementsrelevantto,thecargotobetransportedismadeavailabletotheserviceproviderintimely andreadilyunderstoodmanner.Thisisparticul

NOTE3 Thecustomershouldoperateaformalandeffectivemanagementsystemsoastoensuretheavailabilityofaccurate knowledgewithregardtothestatusandconditionofcargotransferredtotheserviceprovider. 4.2.2 Storage Itistheresponsibilityoftheservicepro
31、vidertoprovideadequatefacilities,whichensurethatthequalityofcargo receiveddoesnotdeteriorateorsufferlossordamageduringtimesofstoragewhilstintransitontrailersorother formsoftransport,orwhenoffloadedfortranshipment.Itisalsotheresponsibilityoftheserviceprovidertoensure thatsuitableandsecurefacilitiesar
32、eprovided,appropriatetothenatureofthecargotobetransported. 4.2.3Transport Itistheresponsibilityoftheserviceprovidertoprovidesuitablemeansoftransportingcargothroughoutthe transportchain,includingequipment,resourceandtrainingasnecessarytoensurethatagreedrequirementscan bemet. 4.2.4 Loss/Damage Itisthe
33、responsibilityoftheserviceprovidertomaintainaformal,effectivemanagementsystem,whichensures thatanylossordamagetothecargothroughoutthetransportprocesscanbeidentifiedattheearliestopportunity andthecustomerinformedifappropriatetodoso.Detailedrecordsofloss/damagefoundshouldbekeptandthe acceptanceofrespo
34、nsibilityforsubsequentactionclearlydefined. 4.2.5 Documentation Itistheresponsibilityoftheserviceprovidertoensuretheavailabilityofcompleteandcorrectdocumentation appropriatetothenatureofthecargo,thetypeofload,thedestinationandmodeoftransportandtotakesuch actionasnecessarytocorrectanydiscrepancies. 35、tisalsotheresponsibilityoftheserviceprovidertoensurethatthereisevidenceofcollectionanddelivery confirmedbypersonsauthorisedtoprovidesuchconfirmationonbehalfofthecustomerorconsignee. 4.2.6 Subcontractors Itistheresponsibilityoftheserviceprovidertoensurethat,intheeventofsubcontractinganypartoftheservi
36、ce, suchsubcontractorsoperateaneffectivemanagementsystemandthecontrolsnecessarytoensurethatthereis nodeteriorationinthequalityofserviceprovided. Theserviceproviderwillberesponsibleformonitoringthemanagementandperformanceofallsubcontractors utilisedintheservice. 5 Managementofquality Itisrecommendedt
37、hattheserviceprovidersmanagementsystemshouldmeettherequirementsofanappropriate andrecognisedstandard.Whilstnotmandatory,itshouldbetheobjectiveofallserviceproviderstoattain independentevaluationandcertificationasadeclarationoftheintegrityoftheirmanagementsystem. ThisCodeofPracticerecommendsthatsuchas
38、tandardshouldmeettherequirementsofENISO9001andthat selfassessmentbeundertakeninthemannersetoutinAnnexAofthisdocument. ItisrecommendedthatserviceprovidersdeclaresperformanceconditionsinthetransportationbyusingEN13011. Itisrecommendedthatcustomersoftransportservicespurchaseserviceswithdeclarationsmeet
39、ingthe requirementsinEN13011anddesignthecombinationofpackaging/productundertherequirementofEN13428.EN13876:2002(E) 7 6Performance 6.1Packaging Itistheresponsibilityoftheserviceprovidertoidentifydamageordeteriorationofthepackagingatanystage duringtheprovisionoftheservice,whichmayadverselyaffectthequa
40、lityofcargo. Itisalsotheresponsibilityoftheserviceprovider,wheredamagehasoccurredandissuchastorenderthecargo unsuitabletobeloaded,transportedortranshipped,toactinthebestinterestsofthecustomerand,where practicable,repackageorsecuretominimiseloss. NOTE1 Thecustomershouldensurethatthecargosubmittedtoth
41、eserviceproviderfortransportisproperlyandsufficient prepared,packed,stowed,labelledand/ormarkedandthatsuchpreparation,packing,stowage,labellingandmarkingare appropriatetoanyoperationsortransactionsaffectingthecargoandthecharacteristicsofthecargo. NOTE2 Thecustomershouldbeawarethatacceptanceofthecarg
42、obytheserviceproviderdoesnotimply,ofitselfthatthe provisionsofnote1havenecessarilybeenmet.Itisrecommendedthatthismatterbethesubjectofspecificconfirmationif required. 6.2 Preparationanddispatch Itistheresponsibilityoftheserviceprovidertoensurethatdetailsofallagreementswiththecustomerrelatingto thepre
43、paration,loading,stowing,securinganddispatchofpackagedproductsareavailabletothepersonnel responsibleforthispartoftheserviceperformance,includingsubcontractors.Thisinformationshouldcontainall relevantaspectssuchasloadinginformation,sequenceofloading,accompanyingdocumentationandproduct identification.Whereappropriatethereshouldbeclearmethodsofidentificationwhichmaintaintraceabilityof productandload/shipmentdetails. NOTE Thecustomershouldensurethat,whereserviceprovidersaretoreceivecargoalreadystowedinacargotransportunit (suchasa
