Limitations on exclusive rights: Fair use Notwithstanding the provis

17、ions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified in that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarshi

18、p, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:The purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educationa

19、l purposes; The nature of the copyrighted work; The amount and substantiality of the portion used in relation to the copyrighted work as a whole; and The effect of the use upon the potential market for or value of the copyrighted work. The fact that a work is unpublished shall not itself bar a findi

Kinkos was held to be infringing copyrights when it photocopied book chapters for sale to students as “coursepacks“ for the

22、ir university classes. Purpose: When conducted by Kinkos, the copying was for commercial purposes, and not for educational purposes. Nature: Most of the works were factualhistory, sociology, and other fields of studya factor which weighed in favor of fair use. Amount: The court analyzed the percenta

23、ge of each work, finding that five to twenty-five percent of the original full book was excessive. Effect: The court found a direct effect on the market for the books, because the coursepacks competed directly with the potential sales of the original books as assigned reading for the students. Concl

24、usion: Three of the four factors leaned against fair use.
